Event Organiser Terms

Every Amator User can create an Event, which is why all Users accept these Terms. The Organiser's obligations arise only once you publish an Event.

§1. Scope

1. These Terms govern how Users of Amator („Organisers") publish and run Events, and form an annex to the Amator Terms of Service.
2. The Operator of the App is AMATOR SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, KRS: 0001253869, NIP: 1133207315.
3. The Operator is not the organiser of Events and is not a party to any relationship between an Organiser and participants. The App is only a noticeboard and organisational tool.

§2. Who can be an Organiser

1. Any User aged at least 16 who has accepted these Terms.
2. An Organiser who publishes paid or recurring Events in an organised and continuous manner is solely responsible for assessing whether their activity requires business registration and for their public-law settlements. The Operator does not intermediate in payments between participants and Organisers and does not settle them.

§3. Organiser's obligations

1. The Organiser is responsible for: a) the accuracy and currency of Event information (place, time, level, number of spots, cost of participation), b) holding a legal title to use the Venue at the stated time (booking, contract, manager's consent), c) complying with the Venue's rules and with local law, d) the safety of the Event and informing participants of material risks, e) checking that the Venue's condition allows the Event to be held safely, f) communicating with participants, including promptly announcing any change or cancellation, g) fair play and equal treatment of participants.
2. The Organiser declares that the Event is not a mass event within the meaning of the Polish Act on the safety of mass events. If the scale makes it one, the Organiser independently fulfils all resulting obligations (permit, medical cover, insurance); publishing mass events without the required permits is prohibited.
3. The Organiser must not mislead participants as to their status, the nature of the Event or the cost of participation.

§4. Liability

1. The Organiser bears full responsibility for personal injury and property damage arising in connection with the Event, to the extent provided by law.
2. The Operator is not liable for: the course of the Event, injuries and accidents, the technical condition of the Venue, negligence of the Organiser or participants, weather, lateness, cancellations or turnout.
3. If, as a result of the Organiser's breach of law or of these Terms, a third party or an authority raises a claim against the Operator, the Organiser undertakes to cooperate in clarifying the matter and to compensate the Operator's loss — to the extent permitted by law and excluding loss caused by the Operator itself. This does not limit consumer rights.
4. The Operator recommends that Organisers hold third-party liability insurance.

§5. The Organiser's own event rules

1. An Organiser may add their own event rules („Own Rules") — e.g. rules of play, equipment requirements, cancellation and refund rules.
2. Own Rules may not conflict with the law, the Amator Terms of Service or these Terms; conflicting provisions are ineffective.
3. Own Rules must be made available to a participant before they join the Event.
4. The Operator does not verify Own Rules and is not liable for their lawfulness or performance.

§6. Participants' data

1. The Organiser receives only the participant data those participants have shared under their privacy settings, and only for the purpose of running the Event.
2. The Organiser must not: demand additional data outside the App as a condition of participation, use participant data for marketing, pass it to third parties, or build separate databases from it.
3. Where an Organiser processes participant data for their own purposes, they become a separate controller and are independently responsible for GDPR compliance.
4. After the Event, the Organiser deletes participant data obtained outside the App.

§7. Communication and Telegram groups

1. Communication may take place through in-app notifications and — optionally — through external Telegram groups.
2. Telegram groups are created as a convenience, remain outside the Operator's control, are subject to Telegram's terms, and joining them is voluntary.
3. An Organiser must not make participation in an Event conditional on joining an external group.
4. The Operator is not liable for content posted in such groups.

§8. Changes and cancellation

1. The Organiser informs participants of any change or cancellation promptly, using the App's features.
2. Where participants have incurred costs towards the Organiser, refunds follow the Own Rules; in their absence, the general rules on the return of undue performance apply.

§9. Breaches

1. The Operator may remove an Event, restrict its visibility, or suspend or delete an Organiser's Account in the event of: breach of law or of the Terms, unlawful content, endangering participants, misleading participants, or persistent cancellations.
2. Decisions under paragraph 1 follow the statement-of-reasons and appeal procedure in §8 of the Amator Terms of Service.

§10. Final provisions

1. These Terms may be amended under the procedure in §15 of the Amator Terms of Service.
2. Matters not covered here are governed by the Amator Terms of Service and by Polish law.
