Coins & Rewards Programme Terms

§1. Programme operator

  1. The „Coins" loyalty programme (the „Programme") is run by AMATOR SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, ul. Stefana Okrzei 1A lok. 5E, 03-715 Warszawa, KRS: 0001253869, NIP: 1133207315 (the „Operator").
  2. The Programme runs inside the Amator App and is free of charge. Coins are credited automatically to every User holding an active Account — participation in the Programme is an integral part of using the App and requires no separate enrolment. Redeeming Coins for Rewards (§4) remains entirely voluntary.

§2. Legal nature of Coins

  1. Coins are internal loyalty points recorded on a User's Account.
  2. Coins are not: electronic money within the meaning of the Polish Payment Services Act, a payment instrument, a security, a crypto-asset or a means of payment.
  3. Coins cannot be: exchanged for cash, transferred to another User, sold, inherited or traded outside the App.
  4. Coins are not a monetary claim against the Operator. A User's entitlement is limited to exchanging Coins for rewards available at the time, under these Terms.

§3. Earning Coins

  1. Coins may be awarded for, among other things: participation in an Event confirmed by the Organiser, submitting post-game ratings, completing a Profile, and other activities indicated in the App.
  2. Current rates are shown in the App and may be changed for the future, under §8.
  3. Coins credited in error, through a technical fault or in connection with abuse (e.g. sham Events, multiple accounts, collusion between participants) may be corrected or cancelled. The Operator informs the User of any correction with reasons; the User may complain (§7).
  4. The balance and accrual history are visible in the App.

§4. Rewards and Partner offers

  1. Coins can be exchanged for rewards or offers presented in the App („Rewards"). The catalogue changes and quantities may be limited — availability is on a first-come basis.
  2. Rewards may come from the Operator or from Partners (businesses cooperating with the Operator).
  3. A Partner Reward is fulfilled by the Partner. The Operator is not the seller or service provider for such a Reward and is not liable for its performance, quality or terms of fulfilment, unless expressly stated otherwise at the Reward. Before collection, the Operator shows the Partner's details and the fulfilment terms.
  4. When you collect a Partner Reward we pass the Partner only the data needed to fulfil it (e.g. a collection code, first name or nickname). The scope is stated at the Reward.
  5. Rewards cannot be exchanged for a cash equivalent.
  6. Complaints about the fulfilment of a Partner Reward should be addressed to the Partner; the Operator will help establish contact and forward the complaint if you send it to [email protected].

§5. Validity of Coins

  1. Coins remain valid for the period stated in the App, and no less than 12 months from accrual. The Operator gives at least 30 days' notice before Coins expire, where a contact channel is available.
  2. Coins expire when the Account is deleted or the Programme ends (§8) and are not paid out or compensated.

§6. Taxes

  1. Promotional rewards may be exempt from personal income tax under Article 21(1)(68) or (68a) of the Polish Personal Income Tax Act, within the limits set by those provisions.
  2. Where the value of a Reward triggers a tax obligation, the Operator or the Partner informs you before the Reward is issued and indicates how it is settled.

§7. Complaints

  1. Complaints about accruals, balances and the operation of the Programme should be sent to [email protected].
  2. Handling time: 14 days for consumers, 30 days otherwise.

§8. Changes and termination of the Programme

  1. The Operator may amend these Terms or end the Programme for important reasons (changes in law, changes in Partner offers, economic or technical considerations).
  2. Changes or termination are announced in the App at least 30 days in advance.
  3. During the notice period Users may spend accumulated Coins on Rewards available in the catalogue. Changes do not affect Rewards already collected.

§9. Final provisions

  1. Matters not covered here are governed by the Amator Terms of Service, the Privacy Policy and Polish law.
  2. Participation requires an active Account and a minimum age of 16.
